Terms of Service

Effective date: October 31, 2026

These terms cover your use of www.cratesaudio.com and anything you get from Crates Audio, a business of MixedByCrates LLC ("Crates Audio," "we," "us"): our free tools, digital products, paid sessions and services. By using the site or buying from us, you agree to these terms. Our Privacy Policy explains how we handle your information.

Using the site

Use the site for its intended purpose. Don't try to break it, scrape it at scale, send spam through our forms or pretend to be someone else. The site's design, copy, images and code belong to Crates Audio or our licensors. You can share links to it, but don't copy it as your own.

Free tools

Our free tools, like the Brand Kit Builder, are provided as is. What you create with them is yours to use for your own show or brand. To unlock a free tool you give us your contact details, and we may follow up by email. You can unsubscribe any time.

Digital products

This covers the Listener Journey Kit, the Episode Workflow Kit, skill packs, templates, prompts and guides.

  • Price and payment. The price is shown at checkout. Payment is processed by Stripe.
  • Delivery. You get access to your Crates members area right after purchase. We email your login details.
  • Your license. You may use the product for your own podcasts and brands. You may not use it to build sites or deliver services for clients, and you may not resell, share, give away, repost or bundle the files, prompts or templates, in whole or in part. Want to use it with clients? Email us about an agency license.
  • Third-party tools. The products are designed to be used with third-party services such as Claude, GoHighLevel and website platforms. Those services have their own terms and pricing, which you're responsible for. We don't control them, and they may change.
  • AI output. The products help you create content and strategy with AI. Review everything before you publish it. You're responsible for what you publish.
  • All sales are final. Digital products are delivered instantly, so we don't offer refunds. If a file is missing or doesn't work, email us and we'll fix it. This doesn't limit any rights you have under the law.

Paid sessions

This covers the Map Session and any other paid one-on-one call.

  • Booking. You book a time through our calendar after purchase.
  • Rescheduling and refunds. Reschedule or cancel up to 48 hours before your call for a full refund. Calls missed without notice, or cancelled less than 48 hours before, are not refunded.
  • Prep and follow-up. Sessions are advice and planning. We'll do our best to give you clear next steps, but decisions about your show and business are yours.

Client services

This covers production, growth, The Build and our monthly plans.

Client work is covered by a separate proposal or agreement that sets out the scope, price, timeline and revision terms. If that agreement conflicts with these terms, the agreement wins. Where the agreement doesn't cover something, these terms apply.

Your content

You keep the rights to your show, recordings, artwork and anything else you send us. By sending it, you give us permission to use it as needed to deliver what you hired us for, including storing it, editing it and processing it with the tools we use. You confirm you have the rights and permissions to everything you send, including from guests, co-hosts and music you include.

We will only feature your project in our portfolio, case studies or marketing with your permission.

No guaranteed results

We work hard to make your show sound great and grow. But downloads, followers, rankings, sales and revenue depend on many things outside our control, so we don't guarantee any specific result.

Text messages

If you opt in, Crates Audio sends text messages about your inquiry, booking or purchase, plus tips and updates.

  • Message frequency varies.
  • Message and data rates may apply.
  • Reply STOP to cancel at any time. You'll get one message confirming you've opted out.
  • Reply HELP for help, or email [email protected].
  • Carriers are not liable for delayed or undelivered messages.
  • Consent to texts is not a condition of any purchase.

Disclaimers

The site, free tools and digital products are provided "as is" and "as available," without warranties of any kind, to the extent the law allows. We don't promise the site will always be available or error free.

Limits on liability

To the extent the law allows, Crates Audio and MixedByCrates LLC are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Indemnity

If someone brings a claim against us because of content you sent us or your breach of these terms, you agree to cover our reasonable costs of dealing with it.

Governing law

These terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in San Joaquin County, California, unless the law requires otherwise. Before filing anything, please email us so we can try to sort it out.

Changes

We may update these terms. We'll change the effective date above. If you keep using the site or our products after an update, you accept the new terms.
